Terms of Service

By creating an account or using CaptionAI, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users, including free and paid plan subscribers.

What CaptionAI Does

CaptionAI is an AI-powered caption generation tool. You upload photos or videos, and we generate social media captions, hashtags, and descriptions using large language model technology.

AI-Generated Content

Captions are generated by AI and may not always be accurate, appropriate, or suitable for your specific context. You are solely responsible for reviewing, editing, and deciding whether to publish any AI-generated content.

Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We are not liable for losses resulting from service unavailability.

Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately if you suspect unauthorized access.

One Account Per Person

Each account is for a single individual. You may not share accounts or create multiple accounts to circumvent plan limits. Business or agency use on behalf of clients requires a single account with appropriate plan.

Account Termination

You may delete your account at any time from Settings. We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

Subscription Plans

CaptionAI offers both free and paid subscription plans. Paid plans are billed monthly or annually as selected. Plan details, pricing, and features are described on our pricing page and may change with notice.

Credits

Each plan includes a monthly allocation of photo and video generation credits. Credits reset at the start of each billing cycle and do not roll over. Unused credits are forfeited at cycle end.

Refunds

We offer a 7-day refund for first-time paid subscriptions if you are unsatisfied. After 7 days, payments are non-refundable. To request a refund, contact support@captionai.app within the eligible window.

Cancellation

You may cancel your subscription at any time. Your plan remains active until the end of the current billing period, after which your account reverts to the free tier.

Price Changes

We may change subscription prices with at least 30 days' advance notice via email. Continued use after a price change constitutes acceptance of the new pricing.

You May Not Use CaptionAI To:

Generate content that is illegal, defamatory, harassing, threatening, sexually explicit, or violates any third-party rights. Impersonate individuals, brands, or public figures. Upload content you do not have the right to use. Attempt to reverse-engineer, scrape, or abuse the service or API. Resell or sublicense access to CaptionAI without written permission.

Content Responsibility

You retain full responsibility for any content you publish using AI-generated captions. CaptionAI is a tool, not a publisher. We are not liable for how you use the captions generated.

Your Content

You retain all ownership rights to the photos and videos you upload. By using CaptionAI, you grant us a limited, non-exclusive license to process your content solely to provide the service.

Generated Captions

Captions generated for your content are yours to use freely, including commercially. We do not claim ownership over AI-generated output produced from your uploads.

CaptionAI Intellectual Property

The CaptionAI name, logo, product design, and underlying technology are owned by us and protected by intellectual property law. You may not copy, replicate, or use our branding without written permission.

API Terms

API access is available on the All-in-One plan. Your API key is personal and must not be shared or exposed in public repositories. You are responsible for all usage under your API key.

Rate Limits

API usage is subject to rate limits (currently 10 requests per minute). Exceeding these limits may result in temporary throttling or, in cases of abuse, account suspension.

CaptionAI is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that AI-generated content will be accurate, complete, or fit for any particular purpose.

To the maximum extent permitted by law, CaptionAI and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months prior to the claim.

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of CaptionAI after the effective date constitutes acceptance of the updated terms.

These Terms are governed by the laws of the jurisdiction in which CaptionAI is registered, without regard to conflict of law provisions. Disputes shall be resolved through good-faith negotiation first, followed by binding arbitration if unresolved.
